1. Introduction
Welcome to Cushy Access, a Q-commerce and Logistics company supporting individuals & businesses with fast, dependable delivery services.
By using our services, you agree to abide by the following terms and conditions. These terms govern your access and use of Cushy Access’ website, mobile app, and services, so please read them carefully.
If you do not agree with these terms, you may not use the platform.
2. Account Creation & Responsibilities
To use our services, you must create an account and provide accurate information. You are responsible for maintaining the confidentiality of your account details and for all activities that occur under your account. If unauthorised access occurs, please notify us immediately.
- You must be at least 18 years old to register.
- Cushy Access reserves the right to suspend or terminate accounts that violate these terms.
3. Services Covered
- Q‑commerce (restaurants, supermarkets, pharmacies)
- Logistics/delivery
- Tele‑consultations with registered medical practitioners.
4. Placing Orders & Consultations
4.1 Q‑commerce orders are confirmed once the merchant accepts.
4.2 Consultations require payment at booking. Appointment slots are held only after payment clears.
4.3 All prices, taxes, delivery fees and service fees displayed at checkout are final.
5. User Conduct
By using Cushy Access, you agree that:
- You will not misuse the services or post unlawful, false, defamatory, or misleading content.
- You will not interfere with the proper working of the platform or attempt to gain unauthorised access to its systems.
- You will provide accurate and complete information during transactions.
Cushy Access may monitor and review user activity and reserves the right to remove any content deemed inappropriate or in violation of these terms.
6. User Content
When you submit reviews, ratings, or any other content (“User Content”) to Cushy Access:
- You represent and warrant that you own the rights to the content or have permission to post it.
- You grant Cushy Access a perpetual, non-exclusive, royalty-free, worldwide license to use, modify, and distribute the User Content in connection with its services.
- Cushy Access reserves the right to remove any User Content without notice if it violates these terms or for any other reason.
7. Orders & Payment
When placing an order through Cushy Access, you agree to pay the prices displayed at checkout. All charges are final and non-refundable once an order is placed and delivered. Prices may vary between those listed on our platform and those offered directly by merchants or elsewhere.
- Cushy Access may modify prices or services at any time without prior notice.
- Refunds or credits may be issued at Cushy Access’ discretion, based on circumstances surrounding each case.
8. Merchant Liability for Product Quality
Cushy Access is a marketplace connecting users with vendors/merchants (restaurants, supermarkets, pharmacies). However, we are not responsible for the quality of the edibles and other consumables provided by these merchants. It is within the sole discretion of users to determine if these products meet their standards.
If there are concerns regarding quality & safety, users can report issues to us.
9. Use of Cushy AI
9.1 Cushy AI Features
Our in‑app AI assistant (“Cushy AI”) may provide:
Personalized product or vendor recommendations
Estimated delivery times and route suggestions
Nutritional, food & health tips
Answers to FAQs about the Platform and services
9.2 Accuracy & Disclaimers
Cushy AI outputs are generated instantly and may not always be 100% accurate. Always verify critical information, especially medical or nutritional advice with the relevant professional.
Delivery estimates are based on historic data and live traffic feeds; actual times may vary.
9.3 Data Use & Privacy
With your consent, we may use your order history, preferences, and interaction logs to train and improve Cushy AI. All data handling remains subject to our Privacy Policy.
You can opt out of AI‑driven personalization at any time via Settings.
9.4 Limitation of Liability
To the fullest extent permitted by law, Cushy Access disclaims liability for any decisions you make based on Cushy AI recommendations.
10. Delivery Services
Cushy Access provides delivery services using both in-house and third-party logistics. We aim to ensure timely and accurate delivery; however, we are not responsible for:
- Delays due to invalid contact number, weather, traffic, or other unforeseen events.
- Incorrect deliveries due to inaccurate addresses provided by the user.
11. Refund Policy
Cushy Access has a no-cash-refund & no-bank-refund policy. Refunds are automatically deposited into your Cushcoin wallet for future use on the platform. The following guidelines apply:
11.1 Q‑commerce Orders
a) If either the user or the merchant cancels the order before it is accepted, an automatic refund is initiated to the user’s Cushcoin wallet.
b) No refunds are allowed once an order is accepted and delivered, unless there is an issue with the delivery or item after acceptance. In such cases, a refund to the user’s wallet will be initiated directly by Cushy Access.
c) Cancellation by either party initiates an automatic refund to the customer’s Cushcoin wallet, without exceptions.
11.2 Tele‑consultations
a) Cancel ≥ 24 hours before → 80% refund.
b) Cancel < 24 hours before → no refund.
c) Doctor‑initiated cancellation → full refund.
12. Orders & Payment
- No payment on delivery: Cushy Access operates strictly on a prepaid basis. All payments for orders, et cetera on Cushy Access must be made using the platform’s digital currency – Cushcoin.
- The only exception is when funding your Cushcoin wallet, which can be done through direct bank transfer or other digital means (Paystack).
13. Cushcoin Wallet System
The Cushcoin Wallet System is designed for ease of use, providing a digital currency solution within the Cushy Access ecosystem. Here’s how it works:
13.1. Funding the Wallet: Users can fund their wallet via direct bank transfer or other digital payment options through Paystack.
13.2. Sending and Receiving Cushcoins: Users can transfer Cushcoins to other users within the platform by using their registered email addresses. However, if a user enters an incorrect email and the funds are transferred, Cushy Access is not liable for any losses incurred.
Similarly, if users send more Cushcoins than intended, Cushy Access is not responsible for the excess amount sent.
13.3. Withdrawals: Withdrawals are not supported, because we are not a fintech.
13.4. Cushcoin Conversion: 1 Cushcoin is equivalent to ₦1.
13.5. Refunds in the Wallet: Once Cushcoins are deposited into your wallet, no refund to bank is allowed, it must be spent within the Cushy Access ecosystem.
14. Other Fees or Charges
- Delivery Fee: This varies based on location.
- Service Fee: This fee covers the packaging costs (including our professional and safe packaging bag and tamper-proof seals) and a 3% fee on the total cart value. This fee helps sustain the platform and ensures smooth operations. (For more details on this, please visit the FAQ section).
15. Promotional Offers & Credits
Cushy Access may offer promotional deals and credits which:
- Are non-transferable, non-redeemable for cash, and can only be used within the time frame specified.
- May be subject to additional terms or restrictions, which will be made available in the offer.
- Cushy Access reserves the right to modify, suspend, or cancel any promotions or credits at its discretion.
16. Dispute Resolution
For disputes regarding the delivered product, delivery services or other services, users are encouraged to contact us directly via our WhatsApp support or by using the Contact form on our platform. And if the need warrants, users are encouraged to provide photos or documents when contacting support for better resolution.
17. Newsletter and Promotional Opt-in
By creating an account on Cushy Access, you are automatically opted-in to our email newsletter and any other promotional systems we may implement.
18. Limitation of Liability
To the fullest extent permitted by law, Cushy Access disclaims all warranties related to the platform and services, including but not limited to warranties of fitness for a particular purpose, accuracy, or timeliness.
Cushy Access is not liable for:
- Any indirect, incidental, or consequential damages arising from the use of our services.
- Any losses due to delays, inaccuracies, or failure in the performance of services due to unforeseen circumstances beyond our control (e.g., natural disasters, internet interruptions).
19. Termination
Cushy Access reserves the right to suspend or terminate your access to our services at any time, with or without notice, for any reason, including a violation of these terms. Upon termination, you remain responsible for any outstanding payments and your license to use the platform will be revoked.
20. Indemnification
You agree to indemnify and hold Cushy Access harmless from any claims, losses, liabilities, damages, costs, and expenses (including legal fees) resulting from:
- Your breach of these terms.
- Your use of the services in violation of any laws or third-party rights.
21. Changes to the Terms
Cushy Access reserves the right to modify these terms at any time. Any changes will be effective immediately upon posting on our platform. Continued use of our services constitutes acceptance of any revised terms.
22. Governing Law
These Terms of Service are governed by the laws of Nigeria. Any disputes arising from these terms or the use of our services will be subject to the exclusive jurisdiction of the courts in Nigeria.
By continuing to use the platform or creating an account, you AGREE to these TERMS AND CONDITIONS.

1. Introduction
Welcome to Cushy Access. Cushy Access is a Q-commerce and Logistics company; amongst other things, the company connects customers with vendors to provide fast, accessible and reliable delivery services. These terms govern your relationship with Cushy Access and your responsibilities as a vendor on our platform.
As a vendor (restaurant, supermarket, or pharmacy owner/runner), you agree to abide by the following terms when offering products via our platform. If you do not agree with these terms, you may not use the platform. These terms govern your relationship with Cushy Access and outline your responsibilities for delivering goods and services to our customers.
2. Account Creation & Responsibilities
Eligibility: You must be a legally registered business in Nigeria and possess all required licenses for your operations (e.g., food handler permits, pharmacy registration).
Accurate Information: You are responsible for providing accurate business and product details, and for keeping your account credentials secure.
Account Suspension/Termination: Accounts may be suspended or terminated for violating these terms, uploading false information, or engaging in fraudulent or unsafe activities.
3. Vendor Conduct
You agree to:
Maintain updated and accurate listings for all products (food, groceries, or pharmaceuticals).
Comply with industry and government standards for food safety, product labelling, and drug regulation. Ensure all edible items are packaged securely and comply with applicable health and safety regulations.
Prepackage all orders properly before pickup.
Update your prices promptly on the platform. If a price change occurs in your establishment and is not reflected on your Cushy Access Vendor account, you will be responsible for any resulting losses.
Avoid selling prohibited items (e.g., controlled substances, expired goods, counterfeit products).
4. Product Quality & Packaging
- Vendor Liability: As a vendor, you are fully responsible for the quality, safety, and integrity of the products you provide. This includes proper packaging to ensure that items remain safe and undamaged during delivery. If customers report issues regarding packaging or product quality, you may face penalties, including temporary suspension from the platform or fines.
- Pre-Packaging Responsibility:
- Vendors must pre-package their items securely in a manner that maintains the integrity, safety, and freshness of the product. Packaging should be appropriate for the type of item being delivered (e.g., liquid items must be sealed in leak-proof containers, hot items must be insulated to retain heat, etc.).
- Pre-packaging must adhere to health and safety standards, ensuring that food items remain uncontaminated and in compliance with regulatory guidelines.
- Use of Cushy Access Branded Packaging:
- Once the products have been safely pre-packaged by the restaurant, they must then be placed into Cushy Access-branded brown bags and sealed using the Cushy Access tamper-proof seals provided. This additional packaging is a mandatory requirement for all deliveries to ensure quality assurance and consistency in presentation.
- The branded packaging is designed to further secure the product and provide a professional appearance upon delivery. Restaurants must always use the branded bags and seals for every order, without exception.
Stock Replenishment: Vendors are responsible for monitoring their inventory of branded packaging materials and must proactively request additional supplies from Cushy Access when stock is low.
Penalties:
Failing to use Cushy Access packaging, or insufficiently packaging orders may result in order cancellation, penalties, or suspension.
Delayed order readiness (beyond 35 minutes after acceptance) will attract a ₦500 penalty per order. This penalty will be credited to the customer as compensation.
5. Revenue and Payment
- Earnings: Your revenue from orders will be credited to your Cushy Access wallet after successful delivery.
- Fees: Cushy Access withholds a commission fee of 5% for every single item sold (far lower than the industry average). No need for vendors to pay additional delivery charges.
- Minimum Withdrawal: There is a minimum withdrawal amount of ₦10,000. Withdrawals must be requested through your vendor account.
- Withdrawal Timeline: After placing a withdrawal request, the funds will reflect in your provided bank account within 24 hours. If funds are not received after this timeframe, you should contact support.
- Misappropriation of Funds: Cushy Access is not responsible for any misappropriation of funds due to incorrect bank account details provided by the vendor.
- Additional Expenses: Any expenses resulting from wrong or incomplete packaging will be deducted from your account at the time of withdrawal. For example, if an item is missing from a customer’s order and the rider needs to return to the restaurant to collect it, the cost of the second delivery trip will be deducted from your earnings. If the customer no longer wants the item or if it is unavailable, the cost of the missing item will be deducted and refunded to the customer’s Cushcoin wallet.
6. License & Ownership of Content
By uploading any materials (including images, descriptions, and promotional content) to Cushy Access, you grant Cushy Access a perpetual, non-exclusive, royalty-free, worldwide license to use, modify, and distribute such materials in connection with its services.
7. Legal Compliance
You agree to comply with:
Food safety & hygiene laws (restaurants & supermarkets)
Nigerian drug laws & NAFDAC regulations (pharmacies)
Any other industry-specific compliance measures required.
8. Promotions & Marketing
Cushy Access may promote your store through various channels, including social media, newsletters, and app notifications. You agree to participate in promotional activities and may be required to provide discounts or special offers as part of such promotions.
9. Dispute Resolution
For disputes related to orders, you are encouraged to resolve them directly with the customer. If further assistance is needed, please contact Cushy Access support. Provide relevant documentation or evidence to facilitate resolution.
10. Limitation of Liability
To the fullest extent permitted by law, Cushy Access disclaims all warranties related to the platform and services. Cushy Access is not liable for:
- Any indirect, incidental, or consequential damages arising from the use of our services.
- Losses due to delays, inaccuracies, or failure in the performance of services due to unforeseen circumstances beyond Cushy Access’ control.
11. Termination
Your account may be terminated for non-compliance or repeated violations. Cushy Access reserves the right to suspend or terminate your account at any time, with or without notice, for any reason, including violation of these terms. Upon termination, you remain responsible for any outstanding obligations, including pending payments.
12. Indemnification
You agree to indemnify and hold Cushy Access harmless from any claims, losses, liabilities, damages, costs, and expenses (including legal fees) resulting from:
- Violations of these terms
- Breaches of law or third-party rights
- Harm caused by your products.
13. Force Majeure
Neither party (Cushy Access nor Vendor) shall be liable for any delay or failure to perform its obligations under this Terms if such delay or failure is caused by a force majeure event, which shall include, but not be limited to, cyberattacks, acts of God, natural disasters, war, terrorism, civil unrest, strikes, lockouts, epidemics, pandemics, or governmental actions.

15. Amendments
Cushy Access may update these terms. Vendors will be notified via dashboard or email. Continued use implies acceptance.
16. Governing Law
These Terms of Service are governed by the laws of Nigeria. Any disputes arising from these terms or your use of our services will be subject to the exclusive jurisdiction of the courts in Nigeria.

1. Introduction
Cushy Access is a Q-commerce platform that also facilitates teleconsultation services by connecting users with licensed health professionals, including medical doctors, therapists, nutritionists, dermatologists, and other certified practitioners. By joining our platform, you agree to the terms outlined below.
2. Eligibility & Registration
You must be a licensed and certified health practitioner in Nigeria with verifiable credentials in your field (e.g. MDCN for doctors, certification bodies for therapists, nutritionists, etc.).
You must upload valid proof of license or certification, along with any other documentation required for verification.
Cushy Access reserves the right to reject or revoke access for practitioners who do not meet our professional standards.
3. Nature of Service
You are providing non-emergency, professional advice or consultation in your certified field.
All consultations must remain within your professional scope of practice.
Cushy Access is not a hospital or clinic, and users are informed that consultations via the platform are for guidance, not emergency care.
If an emergency or high-risk case arises, you are expected to refer the user to a licensed hospital or emergency service immediately.
4. Bookings & Cancellations
Users can book appointment slots that are only confirmed after full payment.
You must be punctual for sessions and give advance notice (≥24 hours) for cancellations.
Missed appointments or repeated lateness without valid reason may result in warnings, penalty, suspension, or permanent removal.
5. Professional Conduct
All practitioners are expected to:
Deliver ethical, respectful, and professional consultation at all times.
Maintain patient confidentiality, following the Hippocratic Oath or equivalent professional ethics.
Avoid misinformation or unverified claims.
Not prescribe controlled substances or medications outside your legal authority.
Prohibited Conduct Includes:
Diagnosing or treating beyond your legal certification
Providing misleading advice
Harassing or discriminating against users
Sharing or saving user information without consent
6. Earnings & Payment
Earnings from each consultation are automatically credited to your Cushy Access wallet upon successful session completion.
Cushy Access may charge a platform commission fee (20%) from each session.
Minimum withdrawal: ₦10,000.
Payouts are processed within 24 hours to your registered bank account.
Ensure your bank details are accurate. Cushy Access is not liable for misdirected transfers.
7. Refund Policy
These rules apply after consultation arrangements have been scheduled from the Cushy Access app:
- User-initiated cancellation ≥ 24 hours before → 80% refund.
- User-initiated cancellation < 24 hours before → no refund.
- Medical practitioner-initiated cancellation → full refund.
8. Privacy & Data Protection
All consultation data (text, video, audio) is encrypted and protected under Nigerian Data Protection Regulations (NDPR).
Practitioners must never store or share user data outside the platform.
You agree to comply with NDPR, and any data breach on your part may lead to legal consequences.
9. Quality Assurance & Reviews
Users may rate or review your services.
Cushy Access monitors practitioner activity to ensure high-quality service.
Poor performance, low ratings, or verified complaints may result in penalties, suspension or removal from the platform.
10. Dispute Resolution
Users may raise complaints about a session.
You agree to cooperate with any investigation and provide clarification when requested.
Cushy Access may mediate disputes and decide resolutions, including refund issuance or platform penalties.
11. Limitation of Liability
Cushy Access is a facilitator, not a healthcare provider.
We are not responsible for:
Any injury or outcome resulting from practitioner advice
Emergency conditions or misdiagnoses
Sessions not conducted on our platform
12. Indemnification
You agree to indemnify Cushy Access from any claims or damages arising from:
Your breach of these terms
Professional misconduct or negligence
Legal violations or user complaints resulting from your actions
13. Termination
Cushy Access may suspend or terminate your account:
If your license/certification expires or becomes invalid
For repeated complaints or rule violations
If you breach user trust or platform policies
14. Legal Compliance
You agree to operate in compliance with:
Nigerian medical and health practice laws
Regulations by MDCN, NMCN, or relevant certifying body
NDPR and data confidentiality laws
15. Amendments
These terms may be updated from time to time. You will be notified via email or dashboard. Continued use implies acceptance of changes.
16. Governing Law
These terms are governed by the laws of Nigeria, and any disputes will be settled in Nigerian courts.
By joining Cushy Access as a health practitioner, you AGREE to these TERMS AND CONDITIONS.
